Under the GDPR, EU consumers are afforded particular rights in relation to their personal information. The GDPR rules are our guide but on tataharperskincare.com all customers have these rights regardless. Following the GDPR we have increased transparency on how our clients can exercise their individual rights pertaining to their personal information. The individual rights afforded under the GDPR, that we provide to our clients,  are as follows:

  1. Right to be informed: Individuals retain the right to be informed of the collection and use of their personal data.

  2. Right of access: Individuals retain the right to access their personal data. This request must be made verbally or in writing.

  3. Right to rectification: Individuals retain the right to have their data rectified should it be inaccurate, or completed if it is incomplete.

  4. Right to erasure: Individuals retain the right to have their personal data erased. This request must be made verbally or in writing, and is only applicable in certain circumstances.

  5. Right to restrict processing: Individuals retain the right to request that their personal data is restricted or suppressed.

  6. Right to data portability: Individuals retain the right to obtain and reuse their data for their own purposes through different services.

  7. Right to object: Individuals retain the right to object to the processing of their personal data. This is only applicable in certain circumstances.

  8. Rights related to automated decision making including profiling: The Individual retains the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

Terms and Conditions

Requirements:
✓All submitted videos must have ad authorization enabled
✓ Participants must be 18+ residents of the U.S. with TTS account in good standing.
✗Make false or misleading claims — they may lead to refunds and damage customer trust.
✗Use AI-generated videos.
✗Create faceless content.
✗Re-upload previously posted videos.

Participants must:
• Post at least 3 new, original TikTok videos, each featuring a Tata Harper product with its TikTok Shop product link.
• Tag @tataharperskincare and use #TataHarper_Partner and #TataHarper_Challenge in each video.
• Keep each video public and materially unedited for 90 days after the challenge period.

Terms[A1.1] and Conditions
By participating in the Tata Harper New Launch Video Challenge, you agree to the above and below terms and conditions:


1. Tata Harper reserves the right to determine eligibility and to reject any enrollment in its sole discretion. The challenge is void where prohibited or restricted by law. Tata Harper may modify, suspend, or cancel the Challenge if fraud, technical failure, changes to TikTok Shop, or other factors beyond its reasonable control impair the Challenge. If cancelled, Prizes will be awarded based on requirements met as of cancellation. Tata Harper will notify Creators of any material changes during the Challenge Period. Tata Harper’s decisions on eligibility, Qualifying Videos, Qualifying Sales, and Prizes are final and binding. If any provision is held unenforceable, the rest remain in effect.

2. Prizes are non-transferable and may not be substituted, except by Tata Harper with a prize of equal or greater value. Product Prizes ship only to U.S. addresses. ARVs are good-faith estimates.

3. Tata Harper may disqualify me immediately by email or TikTok message if it determines, in its sole discretion, that I breached these Terms and Conditions or engaged in fraudulent, deceptive, or inappropriate conduct. Upon withdrawal or disqualification: (i) I will stop representing myself as a Challenge participant; (ii) I will return or destroy any confidential materials; (iii) if disqualified, I forfeit any unawarded Prize and must return any Prize awarded based on fraudulent or non-compliant activity; and (iv) the provisions relating to confidentiality, content license, representations and warranties, taxes, privacy, release, indemnification, limitation of liability, and governing law survive.

4. My content must be respectful and compliant with TikTok's Community Guidelines, TikTok Shop policies, and applicable law. My content must not: (a) infringe any third-party rights; (b) be defamatory, threatening, obscene, sexually explicit, or discriminatory, or promote violence or illegal activity; or (c) make false, misleading, or unsubstantiated claims about Tata Harper products.

5. I will include clear and conspicuous disclosures in each post as set forth above. The disclosure must clearly communicate my relationship with Tata Harper, including that I earn commissions on TikTok Shop sales, that I am participating in a challenge in which I may earn cash and other prizes from Tata Harper, and, where applicable, that I received products for free from Tata Harper. I will convey my honest opinions, findings, beliefs, or experience. I will not make any claim that a Tata Harper product treats, cures, mitigates, or prevents any disease or affects the structure or function of the body, and I will not make any other product performance or attribute claims about Tata Harper products (such as claims about anti-aging effects, skin brightening, acne treatment, or other therapeutic benefits), other than claims included in claims guidance provided by Tata Harper, without the prior.

6. My content will comply with the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising.

7. I grant Tata Harper a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable license to use, reproduce, modify, create derivative works of, distribute, and display all content I create for the Challenge, including qualifying posts, and my name, TikTok handle, likeness, and voice as they appear in content, for marketing and advertising in any media, including paid ads. Tata Harper may edit content, need not use or credit it, and retains these rights after the Challenge ends.

8. I represent and warrant that I own or have all rights needed to grant this license (including written consent from anyone appearing in my Content), my Content does not infringe any third-party intellectual property, publicity, or privacy rights, any music is cleared for commercial use (such as through TikTok's Commercial Music Library), and my Content complies with applicable law.

9. Other than any Prize and my TikTok Shop commissions (if any), I will not receive any compensation for my Content or for promoting Tata Harper products.

10. The Challenge is not sponsored, endorsed, or administered by, or associated with, TikTok, and my use of TikTok Shop remains subject to TikTok's terms.

11. I use Tata Harper products at my own risk, and Tata Harper makes no warranty that they suit my skin type or condition.

12. I am solely responsible for all taxes on any Prize and must provide an IRS Form W-9 and any other requested documentation before any Prize is awarded. Tata Harper or the Agency will issue an IRS Form 1099 where required.

13. Prizes will be distributed/paid out within thirty (30) days after Tata Harper verifies eligibility and receives all required documentation.

14. “Qualifying Sales” means the gross merchandise value of Tata Harper products sold through TikTok Shop and attributed to me from my qualifying videos during the Challenge Period, as reported by TikTok Shop, excluding taxes, shipping, and cancelled, returned, or refunded orders.

15. Winners are determined solely by the objective criteria in these Terms and Conditions, not by chance. Potential winners will be notified by email or TikTok message within 7 days after the Challenge ends and must return a W-9 and any requested eligibility declaration or release within 7 days. Creators who miss this deadline or are ineligible or non-compliant forfeit the Prize.

16. The “Ranch Prize” is a 3-night wellness reset and Tata Harper spa treatment at The Ranch Hudson Valley (outside NYC), a secluded estate about one hour outside New York City, including one guest room, guided hikes, fitness classes, daily massages, meals and snacks, and other amenities offered by The Ranch, plus one Tata Harper spa treatment. The stay must be booked through Tata Harper and completed in calendar year 2027 (programs run Thursday through Sunday), subject to availability and blackout dates. Air and ground transportation, gratuities, incidentals, and other unlisted expenses are not included. The guest must be 18 or older, and both must sign any required releases and follow The Ranch's policies and waivers. The Ranch Prize is non-transferable, has no cash value, and is forfeited if unused by December 31, 2027, without affecting the Tier 1 cash award. The Ranch is not a sponsor of the Challenge.

17. To the fullest extent permitted by law, Tata Harper is not liable for any claims, damages, losses, or expenses (including legal fees) arising from or relating to the Challenge, including my use of Tata Harper products (and any adverse reactions), my content, TikTok or TikTok Shop technical issues or reporting errors, shipping loss or damage, or my acceptance or use of any Prize (including travel to or stays at The Ranch).

18. These Terms and Conditions are governed by New York law, without regard to conflict of law principles, and any dispute relating to the Challenge will be brought exclusively in the state or federal courts in New York County, New York, to whose jurisdiction I consent.

19. Tata Harper’s privacy policy (https://tataharperskincare.com/policies/privacy-policy) is incorporated into these Terms and Conditions.

20. I will indemnify, defend, and hold harmless Tata Harper, its affiliates, the Agency, and their respective officers, directors, employees, and agents (the “Released Parties”) from all claims, losses, and expenses (including reasonable attorneys’ fees) arising from my Content, my breach of these Terms and Conditions, or my violation of law or third-party rights. To the fullest extent permitted by law, I release the Released Parties from all liability for any injury, loss, or damage arising from the Challenge or any Prize.
